Steward Helps Fremont Social Services Worker Challenge Probation Extension and Wins

Danielle Anderson, a Social Services Worker for the Department of Health & Human Services in Fremont, began her career with the state in September 2024. In March 2025, Danielle received a satisfactory probationary evaluation, and she believed she had successfully completed her initial probationary period. 

That’s why it was a surprise to Danielle when, after her first six months were completed and she received her satisfactory evaluation, management gave her a letter that said her initial probationary period was being extended another six months. “I was really surprised, and something seemed off. That’s why I contacted Melissa for help,” Danielle said.

Union steward and NAPE/AFSCME President Melissa Haynes was ready to help Danielle. “I took a look at the extension letter, and noticed right away that it didn’t have any specific reason for the extension, and it was dated after Danielle had completed her initial probationary period,” said Melissa. “So we decided to file a grievance. It was kind of funny, because the grievance argued that Danielle had grievance rights because she wasn’t on probation anymore, but that’s what we had to do to protect Danielle’s rights.”

Our union contract guarantees that state employees end their initial probationary period after completing six months of service, unless the initial probationary period is extended prior to the completion of the initial six months. Also, our contract guarantees that probationary periods which are extended for performance reasons have to contain specific performance improvement requirements. All of that was missing from Danielle’s letter. In the end, the grievance was successful and DHHS recognized Danielle as a permanent employee.

“I actually wasn’t a union member when this all started,” said Danielle. “But I am now!
