Union members are guaranteed access to a flexible schedule under our union contract, as long as the request is reasonable and doesn’t interfere with our ability to provide services to the public. When management told NAPE/AFSCME member and DHHS Lead Social Services Worker Chris Kava that flex schedule requests were limited to extenuating circumstances or for new employees with limited leave balances, he reached out to his union representative for assistance.
“I knew our contract said that flex schedule requests could not be unreasonably denied, and I just needed confirmation that I hadn’t missed something,” said Chris. “My union representative quickly confirmed my understanding of the contract, and helped guide me on how to address the issue with my management.”
When management still refused to approve the flex schedule request, even after Chris communicated his concerns, NAPE/AFSCME began the grievance process to enforce our contract. After the grievance was filed, DHHS agreed it had violated our contract, and returned the leave Chris had to use when his flex schedule request was denied.
“I was glad that my rights were upheld,” said Chris. “I take a lot of pride in my work, and there was no reason for my request to be denied.” If you find yourself having trouble getting a reasonable flex schedule request approved, contact your union representative right away for assistance.
