When NAPE/AFSCME member Aubreeann Patterson was facing potential unjust disciplinary action at work, she knew it was important to contact her union representative right away for help and guidance. Together, they prevailed and protected Aubreann’s rights.
Aubreeann has been a Behavioral Health Practitioner with the Nebraska Department of Correctional Services (NDCS) for eight years. She runs intensive out-patient programming for substance abuse, and she is passionate about providing vital services to the incarcerated population in Omaha.
As a dedicated state employee, Aubreeann was frustrated when it became evident she may face disciplinary action. Our union contract requires state agencies to have just cause to impose disciplinary action, and state employees must be given notice and an opportunity to be heard at a predisciplinary meeting before disciplinary action is imposed.
Aubreeann contacted her union representative to prepare for her predisciplinary meeting, and her representative was able to advocate for her and defend her from unjust disciplinary action.
Our union contract requires agencies to make a disciplinary determination within 30 days of the predisciplinary meeting. Our union negotiated this language so our members wouldn’t be left in limbo for extended periods of time. In Aubreeann’s case, NDCS did not meet the 30 day deadline.
Our union promptly filed a grievance to enforce Aubreeann’s rights. Aubreeann prevailed in her grievance and the disciplinary action was rescinded.
“I felt I was at a disadvantage until I used my collective voice with my union representative. I felt supported,” Aubreeann said. “Having union representation helped with my understanding of my rights. Thankfully, because of union representation, I was able to have a better footing on what rights I have and what protections I have. I have more wisdom moving forward to handle workplace issues.”
When it comes to facing issues in the workplace, Aubreeann’s advice is sound: “Stay the course; the best thing is not to fuel the fire. Stay composed, respectful and professional. Take accountability when you need to take accountability. Lean into people who will encourage you to do the right thing.”
